TERMS OF SERVICE
1.0 Introduction
Welcome to Four19 Online Coaching.
These Terms & Conditions govern the online coaching services provided by Ben Marcussen, trading as Four19("Four19", "we", "our" or "us"). By purchasing or participating in Four19 Online Coaching, you confirm that you have read, understood and agree to be bound by these Terms & Conditions.
Online coaching is designed to provide personalised guidance, support and programming to help you achieve your training goals. It is a collaborative service built upon honest communication, mutual respect and a shared commitment to making meaningful progress.
These Terms & Conditions are intended to clearly outline the responsibilities of both Four19 and the client. They explain the coaching service provided, payment arrangements, communication expectations and the rights and obligations of both parties throughout the coaching relationship.
By proceeding with online coaching, you confirm that:
You are 18 years of age or older.
The information you provide to Four19 is accurate and complete to the best of your knowledge.
You will inform Four19 of any changes to your health or personal circumstances that may affect your ability to participate safely in exercise.
You understand that online coaching is not a substitute for medical advice, diagnosis or treatment.
If you do not agree with these Terms & Conditions, you should not purchase or participate in Four19 Online Coaching.
2.0 The Online Coaching Service
Four19 Online Coaching is a personalised coaching service delivered remotely through the Everfit coaching platform. Every programme is individually designed around your goals, current ability, training experience and the equipment available to you. As your training progresses, your programme will be reviewed and adjusted to ensure it continues to meet your needs.
Your monthly coaching includes:
A personalised training programme tailored specifically to your goals and circumstances.
Full access to your programme through the Everfit mobile application.
Detailed exercise demonstrations and written coaching guidance for each exercise.
Unlimited video submissions for technique analysis and personalised feedback.
Direct communication with Ben through the Everfit messaging platform.
Weekly reviews of your training and ongoing programme adjustments where appropriate.
A monthly personalised video review summarising your progress and discussing the next stage of your training.
Ongoing support, guidance and accountability throughout your coaching.
Online coaching is intended to provide structured guidance, education and support. While every effort will be made to help you achieve your goals, no specific outcomes or results can be guaranteed. Progress will depend upon a range of factors, including consistency, effort, recovery, nutrition, lifestyle and honest communication between both coach and client.
The coaching service is delivered remotely and does not include in-person training sessions, rehabilitation services, physiotherapy, medical advice, nutritional therapy or emergency support unless explicitly agreed in writing.
Four19 reserves the right to modify the coaching service where necessary in order to improve the quality of coaching or to better meet the individual needs of the client. Where significant changes are made, clients will be informed accordingly.
3.0 Communication & Support
Effective communication is fundamental to the success of online coaching. Four19 is committed to providing ongoing guidance and support throughout your coaching, while maintaining clear expectations around communication and response times.
All coaching communication should take place through the Everfit messaging platform unless otherwise agreed. This ensures all conversations, programme updates and coaching advice remain organised and accessible to both coach and client.
Clients are welcome to ask questions relating to their training programme, exercise technique, progress, recovery or any aspect of their coaching. There is no limit to the number of questions or training videos that may be submitted; however, all communication should remain respectful and relevant to the coaching service being provided.
Ben aims to respond to all messages and video submissions within 48 hours during normal working days. Response times may occasionally be longer during weekends, public holidays or periods of annual leave. Where this is the case, clients will be informed whenever reasonably possible.
As part of the coaching service, Four19 provides:
Weekly reviews of your training and ongoing programme adjustments where appropriate.
A personalised monthly video review discussing your progress, highlighting key improvements and outlining the next stage of your training.
Individual feedback on technique videos submitted through Everfit.
Online coaching provides ongoing support but should not be considered an emergency service. If you experience severe pain, illness, injury or any other medical emergency, you should seek appropriate medical advice immediately rather than waiting for a coaching response.
4.0 Client Responsibilities
Online coaching is a collaborative service. While Four19 is committed to providing expert guidance, personalised programming and ongoing support, meaningful progress depends upon the client's commitment to the coaching process.
By participating in Four19 Online Coaching, clients agree to:
Complete their training programme as consistently as reasonably possible.
Communicate honestly about their progress, challenges and any changes that may affect their training.
Inform Four19 of any injury, illness, medical condition or significant change in health before continuing with their programme.
Perform all exercises safely and within their own capabilities.
Ask for guidance whenever they are unsure how to perform an exercise or follow their programme correctly.
Provide accurate information when completing application forms, health questionnaires and progress reviews.
Engage respectfully and professionally in all communication with Four19.
Clients are encouraged to actively participate in the coaching process by completing workouts, submitting technique videos where appropriate and responding to coaching feedback. While periods of reduced training due to work, holidays, illness or personal commitments are completely understandable, ongoing communication is expected so that coaching can be adjusted accordingly.
Four19 cannot guarantee results where coaching advice is consistently disregarded, communication is absent, or training programmes are not followed to a reasonable standard. The effectiveness of online coaching depends upon the client's willingness to engage with the process and apply the guidance provided.
5.0 Health & Medical
The health and wellbeing of every client is a priority. Before commencing online coaching, clients are required to complete a health questionnaire and provide accurate information regarding their current health, medical history and any injuries or conditions that may affect their ability to exercise safely.
By participating in Four19 Online Coaching, you confirm that:
The information you have provided is true, accurate and complete to the best of your knowledge.
You will inform Four19 immediately if your health, medical condition, medication or physical ability changes during your coaching.
You understand that it is your responsibility to seek medical advice where appropriate before beginning or continuing any exercise programme.
You will only perform exercises that you feel capable of completing safely and will stop immediately if you experience pain, dizziness, severe discomfort or any other symptoms that may indicate injury or illness.
Four19 reserves the right to request medical clearance from a suitably qualified healthcare professional before continuing or commencing coaching where there is reason to believe that exercise may present an increased risk to the client.
Online coaching is intended to provide fitness coaching and education only. It does not replace medical advice, diagnosis, treatment, physiotherapy or any other healthcare service. Any recommendations made by Four19 should not be interpreted as medical advice and should not be relied upon as such.
Whilst every effort is made to provide safe, appropriate and effective coaching, participation in any exercise programme carries an inherent risk of injury. By participating in Four19 Online Coaching, you acknowledge and accept these risks and agree to take responsibility for exercising within your own capabilities.
6.0 Payments
Online coaching is charged at £225.00 per calendar month and is payable in advance through Stripe using the payment method provided by the client.
By purchasing Four19 Online Coaching, clients authorise recurring monthly payments until the coaching agreement is cancelled in accordance with these Terms & Conditions.
Clients are responsible for ensuring that their payment details remain valid and that sufficient funds are available on the payment date. If a payment fails, Four19 reserves the right to suspend access to coaching services, including training programmes, communication and programme updates, until payment has been successfully received.
Failure to make payment does not automatically cancel the coaching agreement. Coaching will remain active until cancelled in accordance with Section 7.0 of these Terms & Conditions.
Four19 reserves the right to amend coaching fees in the future. Existing clients will be provided with reasonable notice before any pricing changes take effect and will have the opportunity to cancel their coaching before the new pricing becomes applicable.
All prices are displayed in Pounds Sterling (£) and are inclusive of any taxes applicable to a sole trader at the time of payment.
7.0 Minimum Commitment, Cancellation & Refunds
Online coaching with Four19 is subject to a minimum commitment of three (3) consecutive calendar months. This initial period allows sufficient time to build an effective coaching relationship, make meaningful progress and fairly assess the effectiveness of the coaching provided.
Following the initial three-month commitment, coaching will continue on a rolling monthly basis until cancelled by either party.
Should you wish to cancel your coaching after the initial three-month commitment, written notice must be provided before your next scheduled monthly payment. Coaching will continue until the end of the current paid billing period, after which your recurring payments will cease and access to coaching services will end.
Due to the personalised nature of online coaching, refunds are not available once coaching has commenced, except where required by applicable consumer law. This includes, but is not limited to, refunds for partially used months, missed training sessions, periods of inactivity or failure to engage with the coaching process.
If you choose not to participate in your programme or fail to communicate during your coaching period, your monthly payments will continue as agreed until your coaching has been cancelled in accordance with these Terms & Conditions.
Where exceptional circumstances arise, such as serious illness or injury, Four19 may, at its sole discretion, agree to temporarily pause coaching or make reasonable adjustments to the service. Any such arrangements will be considered on an individual basis and are not guaranteed.
Four19 reserves the right to cancel or suspend coaching where continuation of the service is no longer appropriate or where the client has breached these Terms & Conditions. Where coaching is ended by Four19 for reasons other than client misconduct or a breach of these Terms & Conditions, any unused prepaid coaching fees will be refunded on a pro-rata basis.
8.0 Programme Reviews & Video Feedback
Online coaching is an ongoing process, and each client's training programme will be reviewed regularly to ensure it continues to reflect their progress, goals and individual circumstances.
As part of the coaching service, Four19 provides:
Weekly reviews of completed workouts and training progress, with programme adjustments made where appropriate.
A personalised monthly Loom video reviewing your progress, discussing your recent training and outlining the next stage of your programme.
Unlimited video submissions for exercise technique analysis and personalised feedback.
Clients are encouraged to submit videos whenever they would like feedback on their technique. Whilst there is no limit to the number of videos that may be submitted, feedback will be provided within the communication timeframes outlined in Section 3.0.
To provide accurate coaching, clients should ensure that submitted videos are clear, recorded from an appropriate angle and show the full movement wherever possible. Poor quality or incomplete footage may limit the level of feedback that can be provided.
Programme adjustments are made based on a combination of training performance, recovery, communication, exercise technique and the information provided by the client. Whilst every effort will be made to keep programmes up to date, it remains the client's responsibility to communicate any significant changes that may affect their training.
9.0 Intellectual Property
All training programmes, exercise demonstrations, educational materials, videos, written content and any other resources provided as part of Four19 Online Coaching remain the intellectual property of Ben Marcussen, trading as Four19, unless otherwise stated.
Online coaching is provided solely for the personal use of the individual client. Clients may not copy, reproduce, distribute, modify, share, publish, sell or otherwise make available any coaching materials to any third party without prior written permission from Four19.
This includes, but is not limited to:
Personalised training programmes.
Exercise demonstrations and coaching videos.
Written coaching guidance.
Educational resources.
Monthly review videos.
Exercise libraries.
Downloadable resources and documents.
Clients are welcome to download or save coaching materials for their own personal use during their coaching period; however, ownership of all intellectual property remains with Four19.
Any unauthorised reproduction, distribution or commercial use of Four19's coaching materials may result in the immediate termination of coaching services and, where appropriate, further legal action.
10.0 Ending the Coaching Relationship
Online coaching is built upon mutual trust, honest communication and a shared commitment to achieving meaningful progress. Four19 is committed to providing every client with a professional, respectful and supportive coaching experience and expects the same level of respect in return.
Four19 reserves the right to suspend or terminate the coaching relationship with immediate effect where a client:
Repeatedly fails to engage with the coaching process or maintain reasonable communication.
Provides false or misleading information that may affect the safe delivery of coaching.
Behaves in a threatening, abusive, discriminatory or otherwise inappropriate manner.
Repeatedly ignores important coaching or safety advice where doing so may place themselves or others at unnecessary risk.
Uses Four19's coaching services or resources in a manner that breaches these Terms & Conditions.
Where appropriate, Four19 will make reasonable efforts to resolve any concerns before ending the coaching relationship. However, where continued coaching is considered inappropriate or no longer in the best interests of either party, Four19 reserves the right to end the agreement immediately.
Where coaching is terminated due to a breach of these Terms & Conditions or inappropriate behaviour, no refund will be issued for any remaining period already paid for.
Where coaching is ended by Four19 for reasons unrelated to client conduct or a breach of these Terms & Conditions, any unused prepaid coaching fees will be refunded on a pro-rata basis.
Four19 also reserves the right to refuse or decline coaching applications where it is believed that the service is not an appropriate fit for the individual's needs or circumstances.
11.0 Limitation of Liability
Whilst every reasonable effort will be made to provide safe, effective and personalised coaching, Four19 cannot guarantee specific results. Individual outcomes will vary depending on factors including, but not limited to, consistency, effort, recovery, nutrition, lifestyle, medical history and adherence to the coaching programme.
By participating in Four19 Online Coaching, you acknowledge that all forms of physical exercise carry an inherent risk of injury. You accept full responsibility for your decision to participate and agree to exercise within your own capabilities.
Four19 accepts no responsibility for any injury, illness, loss or damage arising from:
Failure to follow coaching guidance or exercise instructions.
Providing inaccurate, incomplete or misleading health information.
Continuing to exercise against medical advice.
Exercising whilst experiencing pain, illness or injury without first seeking appropriate medical guidance.
The misuse or unauthorised modification of training programmes or coaching materials.
Nothing within these Terms & Conditions excludes or limits any liability that cannot legally be excluded under the laws of England and Wales, including liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.
To the fullest extent permitted by law, Four19's total liability arising from the provision of online coaching shall not exceed the total coaching fees paid by the client during the three months immediately preceding the event giving rise to the claim.
12.0 Privacy, Amendments & Governing Law
Four19 is committed to protecting your personal information and handling it responsibly. Any personal data collected as part of your application, onboarding process or ongoing coaching will be processed in accordance with the Four19 Privacy Policy, which is available on our website.
Four19 reserves the right to amend these Terms & Conditions from time to time where reasonably necessary, including to reflect changes in legislation, business practices or the coaching service provided. Where significant changes are made, existing clients will be given reasonable notice before the updated Terms & Conditions take effect.
If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales, and any disputes arising from the coaching relationship shall be subject to the exclusive jurisdiction of the courts of England and Wales.
